Monserrate Mula, the magistrate of the court of First Instance and Instruction number 3 of Orihuela, was the one who first ordered an in depth investigation into three denunciations that had been made against José Joaquín Moya, the mayor of Bigastro. From February 20th, the investigations in to these three crimes against the Patrimony of the Guardia Civil began in secret.
From the 18th of March, Moya was made aware that this investigation was taking place.
When he was taken into custody on the 21st of this month and subsequently placed in prison, Joaquina de la Peña, the magistrate who sentenced him decided that the investigations would still to continue in secret pending the possibility of formal charges being made.
Concern for his health
Whilst Moya was in gaol at Orihuela he was visited by a doctor and a social worker who agreed that he was suffering from hypertension - only to be expected given his situation. It was not thought necessary to transfer him to the infirmary where prisoners can spend up to weeks recuperating their health.
Moya is now at Fontcalent in Module 3, a unit assigned for first time prisoners.
